CORPORATE RESPONSIBILITY POLICY
The Simpress brand establishes the following corporate policy to delineate the responsibility of the franchises (stores), represented by each corporation that owns it, in relation to the garments that are entrusted for cleaning.
INTRODUCTION
Simpress is committed to provide its services observing the highest quality standards; however, like any service company, Simpress is not exempt from acts beyond its control that could result in damages or losses to our customers. Therefore, in order to clearly delineate our responsibility for any loss or damage resulting from the provision of our services, as a result of an act of negligence or negligence from our staff, Simpress establishes the following policy.
RESPONSIBILITIES OF THE COMPANY
1. Simpress does not offer any guarantee or compensation on the accessories, buttons and applications on garments (breakage, loss, discoloration, deformation, detachment, loss by broken yarn, faded buttons, belts, buckles, accessories, etc.); as well as hardening, loss of sizing, discoloration, resistant indelible stains, problems with garment fiber, discoloration on light colors.
2. Simpress has at its disposal a copy of this policy that regulates the operation of the cleaning, preservation and dyeing service for textile products, leather, furs, synthetics and sewing.
RELEASE OF RESPONSIBILITY AND RESERVATIONS
3. When there is the possibility of deterioration of the garments submitted to the requested treatment, either because they are in poor condition, or because they have to be subjected to special manipulations, or because the client has requested the application of a treatment not suitable, or not recommended by Simpress, the provider must make clear this circumstance (in receipt or form of reservation of parts), a situation that will absolve the provider of any liability for damage or further damages to garments.
LABELS, RESPONSIBILITY AND HIDDEN DAMAGES
4. When there is the possibility of deterioration of the garments due to the requested treatment, either because they are in poor condition or because they have to be subjected to special manipulations, Simpress may be exempted from such responsibility in the event of damage or deterioration, provided that the foreseeable risks have been consigned in the corresponding receipt or invoice or reservation, and the Client has assumed such risk by providing his / her garment (s). In addition, and without any "safeguards" or "reservations", Simpress may be exempted from obvious damages that were present prior to the treatment carried out by the provider, as described in paragraph number 5 of these regulations.
5. Simpress will not be responsible if the deterioration of a garment entrusted to the Company is due to a defect not visible on arrival, such as moth eaten marks, acid drops, hidden items in the seam, mold and / or humidity stain, rust, fungus, burn marks, holes caused by burns etc. (specification for descriptive purposes, but not exclusive). Also we will not be responsible for the deterioration produced by any hidden object inside the garment, such as credit cards, pens, purchase receipts, business cards, and / or personal effects that deteriorate the garments (specification for descriptive purposes, but not exclusive).
6. Simpress will not be responsible for damage caused to the parts entrusted for cleaning, if it complies with the cleaning specifications contained in the label for the treatment of the garments.
7. Garments that do not have a textile composition label and / or treatment label; or that have erroneous labels, will be treated following the regular cleaning procedure. Consequentially, Simpress will not be responsible for any damages that may result on the garments.
TREATMENT OF STAINS
8. Simpress, as part of the service offered, has the obligation to remove dust and dirt from the garments, which does not imply, in any case, a guarantee to remove 100% of the existing stains on the pieces.
BREAK, TEAR AND REPAIRS
9. Tears and breaks susceptible to repair will be repaired by Simpress, without the Client being able to claim any other compensation.
REWORK AND CLAIMS
10. WITHOUT EXCEPTION, claims must be made at the time of delivery of the garment to the customer. No claim will be accepted once garments are removed from our stores. Claims must be made inside the store.
11. The Client recognizes his obligation to check the condition of his or her garments before being entrusted to Simpress for their treatment, and agrees to the fact that by collecting the garments entrusted to the Company, it implies the acceptance of the work carried out. However, Simpress offers a warranty of re-work order, if within a period of seventy-two hours, counted from the time of withdrawal of the garments, the Client demonstrates that their garments have not been cleaned.
12. Simpress will only deal with claims under the aforementioned assumptions, if the Client presents the corresponding invoice or ticket that proves the contracting of the mentioned cleaning service.
INDEMNIFICATION OF SETS, HOUSE AND / OR FURNITURE LINENS
13. The articles or pieces that are part of a "group" that have suffered deterioration or loss (two or three piece sets, for both men or women clothing, etc.) the reimbursement (compensation) of the "set" will be made as long as the total of the pieces that compose it have been entrusted to Simpress for its treatment. In the opposite case, only the part entrusted for its treatment will be compensated.
14. In regards to home and / or furniture linens that are part of a decorative set, Simpress will only reimburse the value of the "set" as long as they have been entrusted in their TOTALITY to our company for their treatment. In the opposite case, only the part entrusted for its treatment will be compensated.
WASH & FOLD SERVICES
15. For Wash & Fold services, Simpress is not responsible for the amount of clothing that is delivered inside the bag, nor for the shrinkage, coloration or discoloration between the clothes within the same Wash & Fold service order. In the case of loss of the entire wash and fold service order, Simpress will indemnify according to the INDEMNIFICATION TABLE.
TURNAROUND TIME
16. The commitment to fulfill the work entrusted, is the general principle that regulates the activity at Simpress. However, there are particular situations, where the specific characteristics of the garments entrusted, make it impossible to strictly comply with these terms. The Client acknowledges and agrees to extend said term to the time necessary to achieve the effective cleaning of the garment received. There is no compensation for delay, extension of the cleaning time or non-compliance with agreed turnaround times for process reasons.
LOSS OF GARMENTS
17. A garment will be considered lost when, as per requested by the customer, Simpress does not return it within a period of 30 (thirty) days from the date of expected turnaround time. In the event that this occurs, Simpress will indemnify the Client as provided by the compensation table exposed to the public, in each of our stores.
ITEMS LEFT UNCLAIMED
18. As per Florida Statutes Chapter 715.03, the Client acknowledges and agrees that after 6 months have progressed since he / she delivered his / her items to Simpress, the latter will be authorized to dispose of such items, free of charge, by donating them to a charity institution.
ERROR IN PAYMENT
19. In the case of an error in the collection of a payment, Simpress will only make a credit in favor of the client to be used in services offered by the store for the amount wrongfully charged.
CAUSES OF FORCE MAJEURE
20. In the case of a natural or threatening catastrophe occurring within the premises that causes the total loss of the clothing delivered to Simpress, the company will pay up to a maximum of $20 per piece on orders that are not more than 30 days from the date of the ticket. Simpress will not be financially responsible for orders with a date reflecting more than 30 (thirty) days.
THIRD-PARTY SERVICES
21. There are services offered by Simpress to its clients that are provided by third parties. These services include treatment of leather, nubuck leather, sewing, dyeing or alterations. The company is not responsible for these services, and claims must be submitted to the subcontracted providers.
AGREEMENT OF TERMS FOR SERVICES PROVIDED
22. The Client acknowledges and agrees that the fact of entrusting his /her pieces to a Simpress (Dry-cleaning), Wash & Fold (drop off of clothing to be washed, dried, and folded on a per pound basis), cleaning in special process and / or water treatment implies that he or she accepts, in accordance with all its parts, this policy, which has been made available to all our customers.
INDEMNIFICATION TABLE
23. The values expressed by type of garment and by longevity of the same, ARE MAXIMUM VALUES that Simpress will grant as compensation. Without exception, all Simpress locations will administer the compensation policy, as published in the table below, to define the indemnity amounts. Higher values will not be compensated to those expressed in the table below.
